Any complaints because of quantity or damages my only be accepted without any doubt if the opening of the packaging is recorded on video showing in good quality and clearly that the package was undamaged at the start of the recording (all sides of the package are recorded) and the recording on the whole content of the package is uncut.<\/p>\n 2.16.4. Products will be delivered between 8 and 17 o\u2019clock on workdays. The Customer shall provide an address and a phone number where he\/she will be available in this period.<\/p>\n 3.1. On the social media surfaces of the Seller, the Customer shall refrain from any act or conduct that is against the law, considered a crime or violation, a breach of any right of other users, the Seller or any third party, or considered threatening, defamatory, slanderous, obscene, vulgar, pornographic, inappropriate, abusive, violent, containing forbidden advertisement, misleading, immoral or incentive to this end, especially from uploading or forwarding such material to the Website or giving or accepting any offer to this end.<\/p>\n 3.2. The Seller will not check any information and content only forwarded, stored or made accessible by it and will not seek any facts or circumstances indicating any activities against the law. The Seller shall not be liable for any infringements of rights of third parties by information originating from an external source and transmitted, stored or made accessible in the course of provision of an information society service. Otherwise, their terms of use shall be governing in respect of each social media platform.<\/p>\n 4.1. Rules on accessory warranty for consumers:<\/p>\n 4.1.1. When can you use your accessory warranty right? <\/em>You may enforce an accessory warranty claim against the Seller in the event of the Seller\u2019s defective performance under the terms of the Civil Code. The Customer shall send the defective products at his\/her own expense to the address of the Seller. The Seller does not accept packages with cash on delivery. Accessory warranty claims may be made against the Seller.<\/p>\n 4.1.2. What rights do you have under your accessory warranty claim? <\/em>You have the following accessory warranty claims options: You may request repair or replacement. If you did not or could not request a repair or replacement, you may request a pro-rata reduction of the service, or you may repair the defect at the Seller\u2019s expense, or you may withdraw from the contract. You may also revert to another accessory warranty right from the one you selected, but you shall bear the cost of the transition, unless it was justified or the Seller made the change necessary.<\/p>\n 4.1.3. What is the deadline for your accessory warranty claim? <\/em>You are required to notify the Seller of the defect immediately, but no later than two months after the discovery of the defect. However, please note that you will no longer be able to enforce your accessory warranty coverage beyond the two-year limitation period for this contract. Within six months of the date of delivery, besides communicating the defect there is no other condition for enforcing your accessory warranty, if you can certify that the product or service was provided by Seller. However, after six months have passed from the date of performance, it is your responsibility to prove that the defect you discovered was present at the time of performance.<\/p>\n 4.2. Product warranties<\/p>\n 4.2.1. In the event of a defect in a movable item (product), you may, depending on your choice, file an accessory warranty claim or a product warranty claim. A product warranty claim only allows you to request the repair or replacement of the defective product.<\/p>\n 4.2.2. A product is defective if it does not meet the quality requirements applicable at the time of placing it on the market or if it does not have the characteristics given by the manufacturer. You can claim your product warranty within two years of the product being marketed by the manufacturer. Upon expiry of that period, you shall lose this entitlement. After the lapse of his period You will lose your claim.<\/p>\n 4.2.3. You can claim your product warranty only against\u00a0the\u00a0manufacturer or distributor of the movable item. You must\u00a0prove the\u00a0defect of the product if you claim a product warranty.<\/p>\n 4.2.4. Please note that you cannot enforce an accessory warranty and a product warranty claim simultaneously for the same defect. However, if your product warranty claim is effectively enforced, you may enforce your accessory warranty claim against the replaced product or part with the manufacturer.<\/p>\n 4.4. Should the product not have the defect, and no other defect is recognized during the examination, the Seller shall not be liable for warranty, the product will not be replaced and the purchase price will not be reimbursed. The Customer shall be entitled to request the redelivery of the products at his\/her own expense.<\/p>\n 5.1. Customers being consumers (a consumer is any natural person acting for purposes which are outside his trade, business or profession, thus the User as such is not) shall have the right to withdraw from the contract in accordance with Government Decree 45\/2014. (II.26.) on Detailed Rules governing contract concluded between consumers and businesses that can be exercised within 14 days from the receipt of the product.<\/p>\n 5.2. In case the withdrawal is made in writing, the right of withdrawal shall be deemed to be exercised within the time limit if the consumer submits the declaration within the time limit. Korm. rendelet szerinti \u201et\u00e1voll\u00e9v\u0151k k\u00f6z\u00f6tt k\u00f6t\u00f6tt szerz\u0151d\u00e9s\u201d j\u00f6n l\u00e9tre a V\u00e1s\u00e1rl\u00f3 (mint vev\u0151) \u00e9s az Elad\u00f3 k\u00f6z\u00f6tt.<\/p>\n 2.3. A megrendel\u00e9seket a Weboldal automatikusan t\u00e1rolja elektronikus form\u00e1ban, ezeket a v\u00e1s\u00e1rl\u00f3 k\u00e9s\u0151bb visszan\u00e9zheti. Felek az elektronikus kereskedelmi szolg\u00e1ltat\u00e1sok, valamint az inform\u00e1ci\u00f3s t\u00e1rsadalommal \u00f6sszef\u00fcgg\u0151 szolg\u00e1ltat\u00e1sok egyes k\u00e9rd\u00e9seir\u0151l sz\u00f3l\u00f3 2001. \u00e9vi CVIII. t\u00f6rv\u00e9ny rendelkez\u00e9seinek megfelel\u0151en meg\u00e1llapodnak, hogy a Weboldalon eszk\u00f6z\u00f6lt megrendel\u00e9s \u00fatj\u00e1n l\u00e9trej\u00f6tt szerz\u0151d\u00e9s \u00edr\u00e1sban megk\u00f6t\u00f6ttnek min\u0151s\u00fcl, a szerz\u0151d\u00e9s magyar nyelven j\u00f6n l\u00e9tre, \u00e9s arra Magyarorsz\u00e1g joga ir\u00e1nyad\u00f3. Tekintettel arra, hogy a szerz\u0151d\u00e9s \u00edr\u00e1sban megk\u00f6t\u00f6tt szerz\u0151d\u00e9snek min\u0151s\u00fcl, a Felek meg\u00e1llapodnak, hogy az Elad\u00f3, valamint a V\u00e1s\u00e1rl\u00f3 k\u00f6z\u00f6tti, a V\u00e1s\u00e1rl\u00f3 megrendel\u00e9si adatai k\u00f6z\u00f6tt szerepl\u0151 email c\u00edmen t\u00f6rt\u00e9n\u0151 kommunik\u00e1ci\u00f3 \u00edr\u00e1sbeli nyilatkozatt\u00e9telk\u00e9nt fogadj\u00e1k el.<\/p>\n 2.5. A megrendel\u00e9sre vonatkoz\u00f3 e-mailen t\u00f6rt\u00e9n\u0151 visszaigazol\u00e1s az Elad\u00f3 \u00e9s a V\u00e1s\u00e1rl\u00f3 k\u00f6z\u00f6tt l\u00e9trej\u00f6tt szerz\u0151d\u00e9s tartalm\u00e1t k\u00e9pezi, \u00e9s annak e-mailen t\u00f6rt\u00e9n\u0151 megk\u00fcld\u00e9se eleget tesz a 45\/2014. (II. 26.) Korm. rendelet 18. \u00a7 szerinti tart\u00f3s adathordoz\u00f3n tett meger\u0151s\u00edt\u00e9s k\u00f6vetelm\u00e9ny\u00e9nek. K\u00e9rj\u00fck, hogy e dokumentumokat olvassa el, \u00e9s \u0151rizze meg! K\u00e9rd\u00e9se eset\u00e9n l\u00e9pjen kapcsolatba az Elad\u00f3val!<\/p>\n 2.6. A megrendel\u00e9sek lead\u00e1sa a Weboldal online fel\u00fclet\u00e9n lehets\u00e9ges. A Weboldalon tett megrendel\u00e9st az Elad\u00f3 csak akkor tudja befogadni \u00e9s teljes\u00edteni, ha a v\u00e1s\u00e1rl\u00f3 a v\u00e1s\u00e1rl\u00e1si oldalon tal\u00e1lhat\u00f3 mez\u0151ket marad\u00e9ktalanul \u00e9s helyesen kit\u00f6lti. Ennek elmulaszt\u00e1s\u00e1b\u00f3l ered\u0151 k\u00e1rok\u00e9rt, illetve a folyamat k\u00f6zben felmer\u00fcl\u0151 technikai probl\u00e9m\u00e1k\u00e9rt a Weboldal felel\u0151ss\u00e9get nem v\u00e1llal. A megrendel\u00e9s elk\u00fcld\u00e9s\u00e9t k\u00f6vet\u0151en \u00e9szlelt adatbeviteli hiba eset\u00e9n ezt halad\u00e9ktalanul jelezni kell a fentiekben megjel\u00f6lt email c\u00edmen.<\/p>\n 2.8. A Weboldalon b\u00f6ng\u00e9szve a kiv\u00e1lasztott, megv\u00e1s\u00e1rolni k\u00edv\u00e1nt term\u00e9kek saj\u00e1t oldal\u00e1n vagy annak el\u0151n\u00e9zet\u00e9ben a \u201eKos\u00e1rba\u201d funkci\u00f3ra klikkelve lehet az egyes term\u00e9keket megrendelni. A term\u00e9k mennyis\u00e9ge a Kos\u00e1r oldalon m\u00f3dos\u00edthat\u00f3, t\u00f6r\u00f6lhet\u0151. A Kos\u00e1r oldalon l\u00e1tszanak a megv\u00e1s\u00e1rolni k\u00edv\u00e1nt term\u00e9kek. A darabsz\u00e1m \u00e1t\u00edr\u00e1s\u00e1val a term\u00e9k mennyis\u00e9ge m\u00f3dos\u00edthat\u00f3. Az \u201eX\u201d gombra kattintva a term\u00e9k elt\u00e1vol\u00edthat\u00f3 a kos\u00e1rb\u00f3l. Felh\u00edvjuk a figyelmet, hogy minden egyes v\u00e9gleges\u00edtett megrendel\u00e9st a Weboldal rendszere k\u00fcl\u00f6n megrendel\u00e9sk\u00e9nt kezel, \u00edgy el\u0151fordulhat, hogy az egym\u00e1s ut\u00e1n k\u00f6zvetlen\u00fcl, azonos v\u00e1s\u00e1rl\u00f3nak \u00e9s c\u00edmre leadott megrendel\u00e9sek is k\u00fcl\u00f6n csomagban ker\u00fclnek kisz\u00e1ll\u00edt\u00e1sra, amely esetben a sz\u00e1ll\u00edt\u00e1si d\u00edj is minden megrendel\u00e9sn\u00e9l k\u00fcl\u00f6n felsz\u00e1m\u00edt\u00e1sra ker\u00fcl. Az oldalon felt\u00fcntettet \u00e1rakat tov\u00e1bbi \u00e1fa nem terheli (az Elad\u00f3 a brutt\u00f3 \u00e1rat t\u00fcnteti fel), kiv\u00e9ve, ha az \u00c1FA k\u00fcl\u00f6n felt\u00fcntet\u00e9sre ker\u00fcl. A brutt\u00f3 \u00e1rak tartalmazz\u00e1k a v\u00e1s\u00e1rl\u00e1skor hat\u00e1lyos jogszab\u00e1lyokban az adott term\u00e9kk\u00f6r tekintet\u00e9ben meghat\u00e1rozott m\u00e9rt\u00e9k\u0171 \u00e1ltal\u00e1nos forgalmi ad\u00f3t. A Weboldalon felt\u00fcntetett \u00e1rak visszavon\u00e1sig vagy megv\u00e1ltoztat\u00e1sig \u00e9rv\u00e9nyesek.<\/p>\n 2.11. A Weboldalon szerepl\u0151 term\u00e9kk\u00e9pek t\u00e1j\u00e9koztat\u00f3 jelleg\u0171ek \u00e9s a val\u00f3s\u00e1gt\u00f3l elt\u00e9rhetnek.<\/p>\n 2.12. Az Elad\u00f3 a jelen \u00c1SZF-ben \u00e9s a megrendel\u00e9s visszaigazol\u00e1s\u00e1ban szerepl\u0151 felt\u00e9telek szerint k\u00f6teles a V\u00e1s\u00e1rl\u00f3 \u00e1ltal megrendelt term\u00e9keket a megrendel\u00e9sben megjel\u00f6lt sz\u00e1ll\u00edt\u00e1si c\u00edmre eljuttatni.<\/p>\n 2.13. A V\u00e1s\u00e1rl\u00f3 k\u00f6teles a term\u00e9ket a megrendel\u00e9skor megadott c\u00edmen \u00e1tvenni, valamint kisz\u00e1ll\u00edt\u00e1st megel\u0151z\u0151en a term\u00e9k v\u00e9tel\u00e1r\u00e1t \u00e9s a felt\u00fcntetett j\u00e1rul\u00e9kos k\u00f6lts\u00e9geket (p\u00e9ld\u00e1ul sz\u00e1ll\u00edt\u00e1s d\u00edja) a jelen \u00c1SZF-ben szerepl\u0151 felt\u00e9telek szerint megfizetni.<\/p>\n 2.14. Az Elad\u00f3 fenntartja a jogot, hogy egyes megrendel\u00e9seket ne fogadjon el, ebben az esetben nem j\u00f6n l\u00e9tre szerz\u0151d\u00e9s a Felek k\u00f6z\u00f6tt. Az Elad\u00f3 tov\u00e1bb\u00e1 jogosult indokol\u00e1s n\u00e9lk\u00fcl el\u00e1llni a szerz\u0151d\u00e9sekt\u0151l, ebben az esetben a m\u00e1r megfizetett v\u00e9tel\u00e1rat halad\u00e9ktalanul visszafizeti a V\u00e1s\u00e1rl\u00f3 r\u00e9sz\u00e9re.<\/p>\n 2.15. Fizet\u00e9si m\u00f3dok<\/p>\n A Web\u00e1ruh\u00e1zban t\u00f6rt\u00e9n\u0151 megrendel\u00e9s sor\u00e1n az al\u00e1bbi fizet\u00e9si m\u00f3dok lehets\u00e9gesek:<\/p>\n – \u00c1tutal\u00e1ssal vagy banki befizet\u00e9ssel;<\/p>\n – Stripe bankk\u00e1rty\u00e1s fizet\u00e9ssel;<\/p>\n – PayPal fizet\u00e9s.<\/p>\n 2.16. \u00c1tv\u00e9teli m\u00f3dok<\/p>\n 2.16.1. Az Elad\u00f3 a megrendelt term\u00e9keket a fut\u00e1rszolg\u00e1lat \u00fatj\u00e1n t\u00f6rt\u00e9n\u0151 kisz\u00e1ll\u00edt\u00e1ssal juttatja el a megadott c\u00edmre.<\/p>\n 2.16.2. Az Elad\u00f3 t\u00f6rekszik a sz\u00e1ll\u00edt\u00e1si hat\u00e1rid\u0151 betart\u00e1s\u00e1ra, azonban nem felel az\u00e9rt, ha ezen szok\u00e1sos sz\u00e1ll\u00edt\u00e1si id\u0151 nem tarthat\u00f3, az egy\u00e9b k\u00f6r\u00fclm\u00e9nyekt\u0151l is f\u00fcgg. Az esetleges k\u00e9sedelem eset\u00e9n az Elad\u00f3 t\u00f6rekszik, de nem k\u00f6teles a v\u00e1s\u00e1rl\u00f3t \u00e9rtes\u00edteni.<\/p>\n 2.16.3. A vev\u0151 k\u00f6teles a kisz\u00e1ll\u00edt\u00e1s id\u0151pontj\u00e1ban a csomag s\u00e9rtetlens\u00e9g\u00e9t, a term\u00e9kek darabsz\u00e1m\u00e1t ellen\u0151rizni, \u00e9s az \u00e1tv\u00e9teli elismerv\u00e9nyt al\u00e1\u00edrni. S\u00e9r\u00fclt csomagol\u00e1s eset\u00e9n a helysz\u00ednen jegyz\u0151k\u00f6nyvben kell r\u00f6gz\u00edteni a hib\u00e1t. Aj\u00e1nlott a term\u00e9k s\u00e9rtetlens\u00e9g\u00e9t is az \u00e1tv\u00e9telkor ellen\u0151rizni, \u00e9s mennyis\u00e9gi hi\u00e1ny vagy s\u00e9r\u00fclt term\u00e9k eset\u00e9n a helysz\u00ednen jegyz\u0151k\u00f6nyvben r\u00f6gz\u00edteni a hi\u00e1nyt vagy hib\u00e1kat. A nem s\u00e9rtetlen csomagol\u00e1s\u00fa term\u00e9ket a v\u00e1s\u00e1rl\u00f3 csak saj\u00e1t felel\u0151ss\u00e9g\u00e9re veheti \u00e1t. A jegyz\u0151k\u00f6nyv felv\u00e9tel\u00e9nek hi\u00e1ny\u00e1ban t\u00e1voll\u00e9v\u0151k k\u00f6z\u00f6tt k\u00f6t\u00f6tt szerz\u0151d\u00e9sek eset\u00e9n ir\u00e1nyad\u00f3 el\u00e1ll\u00e1si jog gyakorl\u00e1s\u00e1ra, mennyis\u00e9gi kifog\u00e1sra, tov\u00e1bb\u00e1 s\u00e9r\u00fclt term\u00e9k miatti szavatoss\u00e1gi ig\u00e9nyek \u00e9rv\u00e9nyes\u00edt\u00e9s\u00e9re a lehet\u0151s\u00e9gek korl\u00e1tozottak. Mennyis\u00e9gi, illetve s\u00e9r\u00fclts\u00e9g miatti reklam\u00e1ci\u00f3 akkor fogadhat\u00f3 el agg\u00e1lytalanul, ha a csomag felbont\u00e1s\u00e1r\u00f3l videofelv\u00e9tel k\u00e9sz\u00fcl, amelyen j\u00f3 min\u0151s\u00e9gben, egy\u00e9rtelm\u0171en l\u00e1tszik, hogy a csomag a felv\u00e9tel indul\u00e1sakor bontatlan volt (a csomag minden oldala felv\u00e9telre ker\u00fcl), \u00e9s a felv\u00e9tel v\u00e1gatlanul r\u00f6gz\u00edti a csomag teljes tartalm\u00e1t.<\/p>\n 2.16.4. A kisz\u00e1ll\u00edt\u00e1s munkanaponk\u00e9nt 8-17 \u00f3ra k\u00f6z\u00f6tt t\u00f6rt\u00e9nik. A v\u00e1s\u00e1rl\u00f3 k\u00f6teles olyan sz\u00e1ll\u00edt\u00e1si c\u00edmet \u00e9s telefonsz\u00e1mot megadni, ahol a fenti id\u0151intervallumban el\u00e9rhet\u0151.<\/p>\n 3.1. Az Elad\u00f3 k\u00f6z\u00f6ss\u00e9gi m\u00e9dia fel\u00fcletein a V\u00e1s\u00e1rl\u00f3 k\u00f6teles tart\u00f3zkodni mindennem\u0171 olyan cselekm\u00e9nyt\u0151l vagy magatart\u00e1st\u00f3l, amely jogellenes, b\u0171ncselekm\u00e9nynek vagy m\u00e1s jogs\u00e9rt\u00e9snek min\u0151s\u00fcl, m\u00e1s V\u00e1s\u00e1rl\u00f3k, a Szolg\u00e1ltat\u00f3 vagy egy\u00e9b harmadik szem\u00e9ly jog\u00e1t vagy jogos \u00e9rdek\u00e9t s\u00e9rti, fenyeget\u0151, becs\u00fclets\u00e9rt\u0151, r\u00e1galmaz\u00f3, obszc\u00e9n, vulg\u00e1ris, illetlen, gyal\u00e1zkod\u00f3, er\u0151szakos, tiltott rekl\u00e1mot tartalmaz, megt\u00e9veszt\u0151, j\u00f3erk\u00f6lcsbe \u00fctk\u00f6z\u0151, illetve ilyennek min\u0151s\u00fcl\u0151 magatart\u00e1sra \u00f6szt\u00f6n\u00f6z, k\u00fcl\u00f6n\u00f6sen az ilyen tartalom vagy anyag Weboldalra vagy k\u00f6z\u00f6ss\u00e9gi m\u00e9di\u00e1ba t\u00f6rt\u00e9n\u0151 felt\u00f6lt\u00e9s\u00e9t\u0151l vagy tov\u00e1bb\u00edt\u00e1s\u00e1t\u00f3l, erre vonatkoz\u00f3 aj\u00e1nlat megt\u00e9tel\u00e9t\u0151l vagy annak elfogad\u00e1s\u00e1t\u00f3l.<\/p>\n 3.2. Az Elad\u00f3 nem ellen\u0151rzi az \u00e1ltala csak tov\u00e1bb\u00edtott, t\u00e1rolt, hozz\u00e1f\u00e9rhet\u0151v\u00e9 tett inform\u00e1ci\u00f3t \u00e9s tartalmat, tov\u00e1bb\u00e1 nem keres olyan t\u00e9nyeket vagy k\u00f6r\u00fclm\u00e9nyeket, amelyek jogellenes tev\u00e9kenys\u00e9g folytat\u00e1s\u00e1ra utalnak. Az Elad\u00f3 nem v\u00e1llal felel\u0151ss\u00e9get a m\u00e1s \u00e1ltal rendelkez\u00e9sre bocs\u00e1tott jogszab\u00e1lyba \u00fctk\u00f6z\u0151 tartalm\u00fa inform\u00e1ci\u00f3val harmadik szem\u00e9lynek okozott jogs\u00e9relem\u00e9rt. Amint az Elad\u00f3 (pl. bejelent\u00e9s alapj\u00e1n) a fentiek ellen\u00e9re m\u00e9gis tudom\u00e1st szerez az inform\u00e1ci\u00f3val kapcsolatos jogellenes magatart\u00e1sr\u00f3l, vagy arr\u00f3l, hogy az inform\u00e1ci\u00f3 b\u00e1rkinek a jog\u00e1t vagy jogos \u00e9rdek\u00e9t s\u00e9rti vagy a jelen \u00c1SZF-be \u00fctk\u00f6zik, halad\u00e9ktalanul int\u00e9zkedik az inform\u00e1ci\u00f3 elt\u00e1vol\u00edt\u00e1s\u00e1r\u00f3l, vagy a hozz\u00e1f\u00e9r\u00e9st nem biztos\u00edtja.<\/p>\n 3.3. Egyebekben az egyes k\u00f6z\u00f6ss\u00e9gi m\u00e9dia fel\u00fcletek vonatkoz\u00e1s\u00e1ban azok felhaszn\u00e1l\u00e1si felt\u00e9telei az ir\u00e1nyad\u00f3ak.<\/p>\n 4.1. Fogyaszt\u00f3kra ir\u00e1nyad\u00f3 kell\u00e9kszavatoss\u00e1gi szab\u00e1lyok:<\/p>\n 4.1.1. Milyen esetben \u00e9lhet a V\u00e1s\u00e1rl\u00f3 a kell\u00e9kszavatoss\u00e1gi jog\u00e1val? <\/em>A V\u00e1s\u00e1rl\u00f3 az Elad\u00f3 hib\u00e1s teljes\u00edt\u00e9se eset\u00e9n az Elad\u00f3val szemben kell\u00e9kszavatoss\u00e1gi ig\u00e9nyt \u00e9rv\u00e9nyes\u00edthet a Polg\u00e1ri T\u00f6rv\u00e9nyk\u00f6nyv szab\u00e1lyai szerint. A hib\u00e1s term\u00e9ket a v\u00e1s\u00e1rl\u00f3 saj\u00e1t k\u00f6lts\u00e9g\u00e9re vagy szem\u00e9lyesen k\u00f6teles az Elad\u00f3 \u00fcgyf\u00e9lszolg\u00e1lati c\u00edm\u00e9re eljuttatni. Az \u00fcgyf\u00e9lszolg\u00e1lat ut\u00e1nv\u00e9tes csomagot nem vesz \u00e1t! A szavatoss\u00e1gi ig\u00e9ny az Elad\u00f3val szemben \u00e9rv\u00e9nyes\u00edthet\u0151.<\/p>\n 4.1.2. Milyen jogok illetik meg a V\u00e1s\u00e1rl\u00f3t kell\u00e9kszavatoss\u00e1gi ig\u00e9nye alapj\u00e1n? <\/em>A v\u00e1s\u00e1rl\u00f3 – v\u00e1laszt\u00e1sa szerint- az al\u00e1bbi kell\u00e9kszavatoss\u00e1gi ig\u00e9nyekkel \u00e9lhet: K\u00e9rhet kijav\u00edt\u00e1st vagy kicser\u00e9l\u00e9st. Ha a kijav\u00edt\u00e1st vagy a kicser\u00e9l\u00e9st nem k\u00e9rte, illetve nem k\u00e9rhette, \u00fagy ig\u00e9nyelheti az ellenszolg\u00e1ltat\u00e1s ar\u00e1nyos lesz\u00e1ll\u00edt\u00e1s\u00e1t vagy a hib\u00e1t az Elad\u00f3 k\u00f6lts\u00e9g\u00e9re a v\u00e1s\u00e1rl\u00f3 is kijav\u00edthatja, illetve m\u00e1ssal kijav\u00edttathatja vagy – v\u00e9gs\u0151 esetben – a szerz\u0151d\u00e9st\u0151l is el\u00e1llhat. V\u00e1lasztott kell\u00e9kszavatoss\u00e1gi jog\u00e1r\u00f3l egy m\u00e1sikra is \u00e1tt\u00e9rhet, az \u00e1tt\u00e9r\u00e9s k\u00f6lts\u00e9g\u00e9t azonban a v\u00e1s\u00e1rl\u00f3 viseli, kiv\u00e9ve, ha az indokolt volt, vagy arra az Elad\u00f3 adott okot.<\/p>\n 4.1.3. Milyen hat\u00e1rid\u0151ben \u00e9rv\u00e9nyes\u00edtheti a V\u00e1s\u00e1rl\u00f3 kell\u00e9kszavatoss\u00e1gi ig\u00e9ny\u00e9t? <\/em>A v\u00e1s\u00e1rl\u00f3 k\u00f6teles a hib\u00e1t annak felfedez\u00e9se ut\u00e1n halad\u00e9ktalanul, de nem k\u00e9s\u0151bb, mint a hiba felfedez\u00e9s\u00e9t\u0151l sz\u00e1m\u00edtott kett\u0151 h\u00f3napon bel\u00fcl k\u00f6z\u00f6lni. Ugyanakkor a v\u00e1s\u00e1rl\u00f3 k\u00f6teles figyelembe venni, hogy a szerz\u0151d\u00e9s teljes\u00edt\u00e9s\u00e9t\u0151l sz\u00e1m\u00edtott k\u00e9t \u00e9ves el\u00e9v\u00fcl\u00e9si hat\u00e1rid\u0151n t\u00fal kell\u00e9kszavatoss\u00e1gi jogait m\u00e1r nem \u00e9rv\u00e9nyes\u00edtheti. A teljes\u00edt\u00e9st\u0151l sz\u00e1m\u00edtott hat h\u00f3napon bel\u00fcl a kell\u00e9kszavatoss\u00e1gi ig\u00e9ny \u00e9rv\u00e9nyes\u00edt\u00e9s\u00e9nek a hiba k\u00f6zl\u00e9s\u00e9n t\u00fal nincs egy\u00e9b felt\u00e9tele, ha a v\u00e1s\u00e1rl\u00f3 igazolja, hogy a term\u00e9ket, illetve a szolg\u00e1ltat\u00e1st az Elad\u00f3 ny\u00fajtotta. A teljes\u00edt\u00e9st\u0151l sz\u00e1m\u00edtott hat h\u00f3nap eltelte ut\u00e1n azonban m\u00e1r a v\u00e1s\u00e1rl\u00f3 k\u00f6teles bizony\u00edtani, hogy az \u00e1ltala felismert hiba m\u00e1r a teljes\u00edt\u00e9s id\u0151pontj\u00e1ban is megvolt.<\/p>\n 4.2. Term\u00e9kszavatoss\u00e1g<\/p>\n 4.2.1. A term\u00e9k hib\u00e1ja eset\u00e9n a v\u00e1s\u00e1rl\u00f3 \u2013 v\u00e1laszt\u00e1sa szerint \u2013 a fenti kell\u00e9kszavatoss\u00e1gi joga helyett term\u00e9kszavatoss\u00e1gi ig\u00e9nyt is \u00e9rv\u00e9nyes\u00edthet. Term\u00e9kszavatoss\u00e1gi ig\u00e9nyk\u00e9nt a v\u00e1s\u00e1rl\u00f3 kiz\u00e1r\u00f3lag a hib\u00e1s term\u00e9k kijav\u00edt\u00e1s\u00e1t vagy kicser\u00e9l\u00e9s\u00e9t k\u00e9rheti.<\/p>\n 4.2.2. A term\u00e9k akkor hib\u00e1s, ha az nem felel meg a forgalomba hozatalakor hat\u00e1lyos min\u0151s\u00e9gi k\u00f6vetelm\u00e9nyeknek vagy pedig, ha nem rendelkezik a gy\u00e1rt\u00f3 \u00e1ltal adott le\u00edr\u00e1sban szerepl\u0151 tulajdons\u00e1gokkal. Term\u00e9kszavatoss\u00e1gi ig\u00e9nyt a v\u00e1s\u00e1rl\u00f3 a term\u00e9k gy\u00e1rt\u00f3 \u00e1ltali forgalomba hozatal\u00e1t\u00f3l sz\u00e1m\u00edtott k\u00e9t \u00e9ven bel\u00fcl \u00e9rv\u00e9nyes\u00edtheti. E hat\u00e1rid\u0151 eltelt\u00e9vel ezen ig\u00e9ny\u00e9rv\u00e9nyes\u00edt\u00e9si jogosults\u00e1ga elv\u00e9sz.<\/p>\n 4.2.3. Term\u00e9kszavatoss\u00e1gi ig\u00e9ny kiz\u00e1r\u00f3lag az Elad\u00f3val szemben gyakorolhat\u00f3. A term\u00e9k hib\u00e1j\u00e1t term\u00e9kszavatoss\u00e1gi ig\u00e9ny \u00e9rv\u00e9nyes\u00edt\u00e9se eset\u00e9n a v\u00e1s\u00e1rl\u00f3nak kell bizony\u00edtania.<\/p>\n 4.2.4. A gy\u00e1rt\u00f3 (forgalmaz\u00f3) kiz\u00e1r\u00f3lag akkor mentes\u00fcl term\u00e9kszavatoss\u00e1gi k\u00f6telezetts\u00e9ge al\u00f3l, ha bizony\u00edtani tudja, hogy:<\/p>\n – a term\u00e9ket nem \u00fczleti tev\u00e9kenys\u00e9ge k\u00f6r\u00e9ben gy\u00e1rtotta, illetve hozta forgalomba, vagy<\/p>\n – a hiba a tudom\u00e1ny \u00e9s a technika \u00e1ll\u00e1sa szerint a forgalomba hozatal id\u0151pontj\u00e1ban nem volt felismerhet\u0151 vagy<\/p>\n – a term\u00e9k hib\u00e1ja jogszab\u00e1ly vagy k\u00f6telez\u0151 hat\u00f3s\u00e1gi el\u0151\u00edr\u00e1s alkalmaz\u00e1s\u00e1b\u00f3l ered.<\/p>\n <\/p>\n 4.2.5. A gy\u00e1rt\u00f3nak (forgalmaz\u00f3nak) a mentes\u00fcl\u00e9shez elegend\u0151 egy okot bizony\u00edtania.<\/p>\n 4.3. Ugyanazon hiba miatt kell\u00e9kszavatoss\u00e1gi \u00e9s j\u00f3t\u00e1ll\u00e1si ig\u00e9nyt, illetve term\u00e9kszavatoss\u00e1gi \u00e9s j\u00f3t\u00e1ll\u00e1si ig\u00e9nyt egyszerre, egym\u00e1ssal p\u00e1rhuzamosan nem lehet \u00e9rv\u00e9nyes\u00edteni, egy\u00e9bk\u00e9nt viszont a j\u00f3t\u00e1ll\u00e1sb\u00f3l fakad\u00f3 jogok a fogyaszt\u00f3t a kell\u00e9kszavatoss\u00e1g \u00e9s term\u00e9kszavatoss\u00e1g alapj\u00e1n megillet\u0151 jogosults\u00e1gokt\u00f3l f\u00fcggetlen\u00fcl megilletik. Term\u00e9kszavatoss\u00e1gi ig\u00e9ny eredm\u00e9nyes \u00e9rv\u00e9nyes\u00edt\u00e9se eset\u00e9n azonban a kicser\u00e9lt term\u00e9kre, illetve kijav\u00edtott r\u00e9szre vonatkoz\u00f3 kell\u00e9kszavatoss\u00e1gi ig\u00e9ny\u00e9t a gy\u00e1rt\u00f3val szemben \u00e9rv\u00e9nyes\u00edtheti.<\/p>\n 4.4. Amennyiben a hib\u00e1sk\u00e9nt megjel\u00f6lt term\u00e9k nem rendelkezik a hib\u00e1val, \u00e9s a bevizsg\u00e1l\u00e1s alatt m\u00e1s hiba sem v\u00e1lik felismerhet\u0151v\u00e9, \u00fagy az Elad\u00f3t szavatoss\u00e1gi k\u00f6telezetts\u00e9g nem terheli, a term\u00e9ket nem cser\u00e9li, \u00e9s v\u00e9tel\u00e1r\u00e1t nem t\u00e9r\u00edt vissza. A v\u00e1s\u00e1rl\u00f3 jogosult ugyanakkor ilyen esetben k\u00e9rni a term\u00e9k saj\u00e1t k\u00f6lts\u00e9g\u00e9n t\u00f6rt\u00e9n\u0151 \u00fajb\u00f3li kisz\u00e1ll\u00edt\u00e1s\u00e1t.<\/p>\n 5.1. A Weboldal fogyaszt\u00f3nak min\u0151s\u00fcl\u0151 (a szakm\u00e1ja, \u00f6n\u00e1ll\u00f3 foglalkoz\u00e1sa vagy \u00fczleti tev\u00e9kenys\u00e9ge k\u00f6r\u00e9n k\u00edv\u00fcl elj\u00e1r\u00f3 term\u00e9szetes szem\u00e9ly) v\u00e1s\u00e1rl\u00f3it megilleti a t\u00e1vollev\u0151k k\u00f6z\u00f6tt k\u00f6t\u00f6tt szerz\u0151d\u00e9sekr\u0151l sz\u00f3l\u00f3 45\/2014. (II.26.) Korm. rendelet szerinti el\u00e1ll\u00e1si jog, amelyet a term\u00e9k k\u00e9zhezv\u00e9tel\u00e9t k\u00f6vet\u0151 14 napon bel\u00fcl lehet gyakorolni.<\/p>\n 5.2. \u00cdr\u00e1sban t\u00f6rt\u00e9n\u0151 el\u00e1ll\u00e1s eset\u00e9n hat\u00e1rid\u0151ben \u00e9rv\u00e9nyes\u00edtettnek kell tekinteni, ha a v\u00e1s\u00e1rl\u00f3 el\u00e1ll\u00e1si nyilatkozat\u00e1t a hat\u00e1rid\u0151 lej\u00e1rta el\u0151tt elk\u00fcldi. Az el\u00e1ll\u00e1s az itt megjel\u00f6lt felt\u00e9telekkel gyakorolhat\u00f3.<\/p>\n 5.3. El\u00e1ll\u00e1s eset\u00e9n a term\u00e9k bontatlan vagy bontott \u00e1llapotban \u00e9rkezhet vissza az Elad\u00f3hoz. Ut\u00e1nv\u00e9ttel visszak\u00fcld\u00f6tt term\u00e9ket az Elad\u00f3 nem vesz \u00e1t.<\/p>\n 5.4. Az Elad\u00f3 kiz\u00e1r\u00f3lag s\u00e9r\u00fcl\u00e9smentes vagy a rendeltet\u00e9sszer\u0171 haszn\u00e1latot meg nem halad\u00f3an haszn\u00e1lt \u00e9s tiszta term\u00e9k visszaszolg\u00e1ltat\u00e1sa eset\u00e9n k\u00f6teles a teljes v\u00e9tel\u00e1rat a v\u00e1s\u00e1rl\u00f3 r\u00e9sz\u00e9re megt\u00e9r\u00edteni. Az Elad\u00f3 k\u00f6vetelheti a fogyaszt\u00f3t\u00f3l a term\u00e9kek nem rendeltet\u00e9sszer\u0171 haszn\u00e1lat\u00e1b\u00f3l vagy nem megfelel\u0151 visszaszolg\u00e1ltat\u00e1s\u00e1b\u00f3l ered\u0151 k\u00e1rai megt\u00e9r\u00edt\u00e9s\u00e9t.<\/p>\n 5.5. El\u00e1ll\u00e1sra vonatkoz\u00f3 ig\u00e9nyt a v\u00e1s\u00e1rl\u00f3 e-mailben, postai \u00faton \u00edr\u00e1sban vagy szem\u00e9lyesen jelentheti be.<\/p>\n 5.6. Az id\u00e9zett jogszab\u00e1lyon alapul\u00f3 el\u00e1ll\u00e1st nem kell megindokolni.<\/p>\n 5.7. El\u00e1ll\u00e1s eset\u00e9n a term\u00e9k visszajuttat\u00e1s\u00e1nak k\u00f6lts\u00e9gei a v\u00e1s\u00e1rl\u00f3t terhelik. A v\u00e1s\u00e1rl\u00f3t ezen fel\u00fcl egy\u00e9b k\u00f6lts\u00e9g nem terheli. A v\u00e1s\u00e1rl\u00f3 a term\u00e9ket az el\u00e1ll\u00e1sra vonatkoz\u00f3 jognyilatkozata k\u00f6zl\u00e9s\u00e9t k\u00f6vet\u0151 14 napon bel\u00fcl k\u00f6teles visszajuttatni az Elad\u00f3nak, ennek hi\u00e1ny\u00e1ban \u00fagy kell tekinteni, hogy az el\u00e1ll\u00e1si jog\u00e1t a tov\u00e1bbiakban nem k\u00edv\u00e1nja gyakorolni.<\/p>\n 5.8. A term\u00e9k ellen\u00e9rt\u00e9k\u00e9t, valamint a sz\u00e1ll\u00edt\u00e1si k\u00f6lts\u00e9get (ha felsz\u00e1m\u00edt\u00e1sra ker\u00fclt) legk\u00e9s\u0151bb a term\u00e9k Elad\u00f3hoz val\u00f3 meg\u00e9rkez\u00e9st k\u00f6vet\u0151 14 napon bel\u00fcl utalja vissza a v\u00e1s\u00e1rl\u00f3 \u00e1ltal megadott banksz\u00e1mlasz\u00e1mra. A visszat\u00e9r\u00edt\u00e9s vonatkozik a term\u00e9k v\u00e1s\u00e1rl\u00f3 r\u00e9sz\u00e9re t\u00f6rt\u00e9n\u0151 kisz\u00e1ll\u00edt\u00e1si k\u00f6lts\u00e9gekre is, kiv\u00e9ve, ha az el\u00e1ll\u00e1ssal \u00e9rintett term\u00e9kkel egy\u00fctt m\u00e1s olyan term\u00e9k is kisz\u00e1ll\u00edt\u00e1sra ker\u00fclt, amely tekintet\u00e9ben a v\u00e1s\u00e1rl\u00f3 nem \u00e9lt el\u00e1ll\u00e1si jog\u00e1val. Elad\u00f3 a v\u00e9tel\u00e1rat a term\u00e9k visszaszolg\u00e1ltat\u00e1s\u00e1ig visszatarthatja.<\/p>\n 5.9. Amennyiben egy megrendel\u00e9s t\u00f6bb t\u00e9telre vonatkozott \u00e9s az el\u00e1ll\u00e1s nem terjed ki valamennyi term\u00e9kre, \u00fagy az Elad\u00f3 nem t\u00e9r\u00edti vissza a kisz\u00e1ll\u00edt\u00e1s d\u00edj\u00e1t.<\/p>\n 6.1. A Weboldalon el\u0151fordulhatnak el\u00edr\u00e1sok, \u00edgy t\u00e9ves \u00e1rmegjel\u00f6l\u00e9sek, a k\u00f6zz\u00e9tett adatok\u00e9rt az Elad\u00f3 nem v\u00e1llal felel\u0151ss\u00e9get, fenntartja a jogot, hogy ilyen esetben ne fogadja el a megrendel\u00e9st \u00e9s ne k\u00f6ss\u00f6n szerz\u0151d\u00e9st, illet\u0151leg a szerz\u0151d\u00e9s megk\u00f6t\u00e9se eset\u00e9n att\u00f3l el\u00e1lljon.<\/p>\n 6.2. Az egyes term\u00e9kek sz\u00edneit a v\u00e1s\u00e1rl\u00f3 sz\u00e1m\u00edt\u00f3g\u00e9pe a val\u00f3s\u00e1gt\u00f3l elt\u00e9r\u0151en jelen\u00edtheti meg, \u00edgy a sz\u00ednek teljes egyez\u0151s\u00e9g\u00e9\u00e9rt az Elad\u00f3 felel\u0151ss\u00e9get nem v\u00e1llal.<\/p>\n 6.3. A Weboldalon val\u00f3 v\u00e1s\u00e1rl\u00e1s felt\u00e9telezi a v\u00e1s\u00e1rl\u00f3 r\u00e9sz\u00e9r\u0151l az internet lehet\u0151s\u00e9geinek \u00e9s korl\u00e1tainak ismeret\u00e9t \u00e9s elfogad\u00e1s\u00e1t, k\u00fcl\u00f6n\u00f6s tekintettel a technikai teljes\u00edtm\u00e9nyekre \u00e9s a lehets\u00e9ges hib\u00e1kra.<\/p>\n 6.4. A Weboldal semmilyen m\u00f3don nem felel\u0151s az al\u00e1bb felsorolt pontokban foglaltak miatt, b\u00e1rmilyen okb\u00f3l is k\u00f6vetkeztek be:<\/p>\n 6.5. A Weboldal nem felel\u0151s semmilyen alapon, semmilyen k\u00f6zvetlen vagy k\u00f6zvetett k\u00e1r\u00e9rt, ami a Weboldal \u00e1ruh\u00e1zhoz val\u00f3 csatlakoz\u00e1s, a Weboldal megtekint\u00e9se miatt k\u00f6vetkezett be.<\/p>\n 6.6. A panaszok bejelent\u00e9s\u00e9re, kapcsolattart\u00e1sra haszn\u00e1lhat\u00f3 c\u00edm, telefonsz\u00e1m, elektronikus levelez\u00e9si c\u00edm a fentiekben ker\u00fclt megjel\u00f6l\u00e9sre.<\/p>\n 9.2. A v\u00e1s\u00e1rl\u00f3 panasz\u00e1t sz\u00f3ban (szem\u00e9lyesen vagy telefonon) vagy \u00edr\u00e1sban jelentheti be a Weboldal el\u00e9rhet\u0151s\u00e9gein. Nem min\u0151s\u00fcl panasznak, ha a v\u00e1s\u00e1rl\u00f3 a Weboldal m\u0171k\u00f6d\u00e9s\u00e9vel, tev\u00e9kenys\u00e9g\u00e9vel kapcsolatosan t\u00e1j\u00e9koztat\u00e1st, \u00e1ll\u00e1sfoglal\u00e1st k\u00e9r.<\/p>\n 9.3. Az Elad\u00f3 a sz\u00f3beli panaszt azonnal megvizsg\u00e1lja, \u00e9s sz\u00fcks\u00e9g szerint orvosolja. Ha a v\u00e1s\u00e1rl\u00f3 a panasz kezel\u00e9s\u00e9vel nem \u00e9rt egyet, illetve ha a panasz azonnali kivizsg\u00e1l\u00e1sa nem lehets\u00e9ges, a Elad\u00f3 a panaszr\u00f3l \u00e9s az azzal kapcsolatos \u00e1ll\u00e1spontj\u00e1r\u00f3l halad\u00e9ktalanul jegyz\u0151k\u00f6nyvet vesz fel, s annak egy m\u00e1solati p\u00e9ld\u00e1ny\u00e1t a v\u00e1s\u00e1rl\u00f3nak \u00e1tadja, egyebekben pedig a k\u00f6vetkez\u0151 pont szerint j\u00e1r el.<\/p>\n 9.4. Az \u00edr\u00e1sbeli (ide\u00e9rtve az elektronikus \u00faton) valamint telefonon tett panaszt az Elad\u00f3 \u2013 t\u00f6rv\u00e9ny elt\u00e9r\u0151 rendelkez\u00e9se hi\u00e1ny\u00e1ban \u2013 harminc napon bel\u00fcl \u00edr\u00e1sban megv\u00e1laszolja. Az ilyen m\u00f3don el\u0151terjesztett panaszt az Elad\u00f3 egyedi azonos\u00edt\u00f3sz\u00e1mmal l\u00e1tja el. A v\u00e1laszhoz a Weboldal csatolja a panaszr\u00f3l felvett jegyz\u0151k\u00f6nyvet is. A r\u00f6gz\u00edtett panasznak tartalmaznia kell a panaszos nev\u00e9t, c\u00edm\u00e9t, \u00e9s a panasz le\u00edr\u00e1s\u00e1t. A panaszt elutas\u00edt\u00f3 \u00e1ll\u00e1spontj\u00e1t a v\u00e1llalkoz\u00e1s indokolni k\u00f6teles, tov\u00e1bb\u00e1 felh\u00edvja a v\u00e1s\u00e1rl\u00f3 figyelm\u00e9t a jogorvoslati lehet\u0151s\u00e9gekre. A v\u00e1lasz m\u00e1solati p\u00e9ld\u00e1ny\u00e1t \u00f6t \u00e9vig k\u00f6teles meg\u0151rizni, s azt az ellen\u0151rz\u0151 hat\u00f3s\u00e1goknak k\u00e9r\u00e9s\u00fckre bemutatni.<\/p>\n 9.5. Jogorvoslat: Fogyaszt\u00f3 jogosult tov\u00e1bb\u00e1 b\u00e9k\u00e9ltet\u0151 test\u00fclethez fordulni.
